Marksy — Trademark search, research and flat-fee services

Your virtual trademark department

A virtual trademark department for companies without one

Large companies have a trademark department: someone who clears names before launch, files, watches the register, keeps the docket and acts when a look-alike appears. Most companies have none, and find out what that costs at the worst moment. Marksy is that department as a service — research, filing, watching, docketing and enforcement, each at a posted flat fee, with independent attorneys where the law requires them.

What the department does

  1. Clears names before launch. Free knockout search across the federal register; comprehensive clearance with state and common-law sources and a written attorney opinion; a brand builder that pre-screens generated names against live marks and domains.
  2. Files and prosecutes. Flat-fee application packages, office action responses by refusal type, statements of use, renewals — prepared from organized intake and filed by an independent attorney of record.
  3. Watches the register. Daily monitoring for confusingly similar new filings, with a triage inbox that explains why each hit matched; tracking for any mark with status-change alerts.
  4. Keeps the docket. Every deadline the rules engine can derive — office action responses, statement of use windows, §8, §9 and §15 — with reminders at 90, 30 and 7 days and a calendar feed.
  5. Reports portfolio health. Owner import in bulk, health tiles for the portfolio, risk of confusion scored against your own marks, and analytics on the landscape.
  6. Acts on conflicts. Cease-and-desist letters, co-existence agreements, oppositions and cancellations before the TTAB, marketplace takedowns — priced flat, performed by independent counsel.

Why a virtual department rather than an hourly firm

Questions

Is this for one mark or a portfolio?

Both. Tracking and watch work per mark; the portfolio import, health tiles and bulk watch are built for companies with dozens or hundreds of registrations.

Do I have to buy a subscription?

No. Search is free, tracking is free with an account, and each service is ordered at its flat fee. Search subscriptions add quota and tools for heavy research use.

Who is the attorney?

Legal services are provided by independent counsel, currently MC Law, PLLC, which serves as attorney of record for referred matters. Marksy provides the technology, research, intake and administration.
