Trademark Search Tips

Master the art of searching registered trademarks on Marksy

Conducting an effective trademark search is crucial before filing an application. These tips will help you find potentially conflicting marks and make informed decisions about your brand name. Here are our top 10 tips for searching trademarks on Marksy:

1

Use a "Wildcard" Asterisk to Find Confusingly Similar Names

The asterisk (*) is your most powerful search tool. It acts as a placeholder for any number of characters, helping you discover marks that are phonetically or visually similar to yours.

Example: TECH* will find TECH, TECHNO, TECHNOLOGY, TECHSMART, TECHIFY, and more.
Pro Tip: Use wildcards at the beginning, middle, and end: *SOFT* finds MICROSOFT, SOFTBANK, ULTRASOFT, etc.
2

Use a "Wildcard" Asterisk in Place of Special Punctuation

Trademarks often include dashes, exclamation points, apostrophes, and other punctuation. Replace these with asterisks to ensure you don't miss any matches.

Example: If searching for "E-COMMERCE", try: E*COMMERCE
This finds: E-COMMERCE, E COMMERCE, ECOMMERCE, E.COMMERCE, and similar variations.
3

Search Individual Words Separately

If your mark contains multiple words, search for each word independently. Trademark conflicts often arise from similarities in just one component of a mark.

Example: For "BLUE MOUNTAIN COFFEE", search:
  • BLUE + your goods/services
  • MOUNTAIN + your goods/services
  • BLUE MOUNTAIN
4

Search Words in Different Orders

The USPTO considers marks with rearranged words potentially confusing. Always search your words in various combinations.

Example: For "SMART HOME SOLUTIONS", also search:
  • HOME SMART SOLUTIONS
  • SOLUTIONS SMART HOME
  • SMART SOLUTIONS HOME
5

Search for Phonetic Equivalents

Trademarks that sound alike can be considered confusingly similar, even if spelled differently. Search for phonetic variations of your mark.

Example: For "KLEEN", also search:
  • CLEAN
  • CLEEN
  • KLEAN
  • KLENE
6

Consider Common Letter Substitutions

Many trademarks use creative spelling with letter substitutions. Search for these variations to find potential conflicts.

Common substitutions:
  • "K" for "C" (KOOL vs COOL)
  • "Z" for "S" (TOYZ vs TOYS)
  • "X" for "CKS" (TRAX vs TRACKS)
  • "PH" for "F" (PHRESH vs FRESH)
  • "I" for "Y" (HAPPIE vs HAPPY)
7

Search Your Relevant Trademark Classes

Focus your search on the specific International Classes that apply to your goods or services. This helps identify the most relevant potential conflicts.

Example: If you're selling clothing, filter by Class 25 (Clothing). If you're offering software, use Class 9 (Computer Software) and Class 42 (Software as a Service).
Note: Don't forget related classes! A clothing brand might also need to search Class 35 (Retail Services).
8

Include Common Prefixes and Suffixes

Many trademarks add common business terms as prefixes or suffixes. Search with and without these additions.

Common additions to search:
  • Prefixes: PRO-, ULTRA-, MEGA-, SUPER-, MY-, E-, I-
  • Suffixes: -LY, -IFY, -HUB, -LAB, -WORKS, -CO, -IO
Example: For "DESIGN", also search: PRODESIGN, DESIGNIFY, DESIGNHUB, MYDESIGN
9

Search for Foreign Equivalents

The USPTO may consider foreign words that translate to English marks as confusingly similar. This is known as the "Doctrine of Foreign Equivalents."

Example: If your mark is "THE SUN", also search:
  • EL SOL (Spanish)
  • LE SOLEIL (French)
  • DIE SONNE (German)
10

Check Both Live and Dead Marks

While dead marks can sometimes be adopted, it's important to understand why they were abandoned. Some dead marks may still have common law rights or could be revived.

On Marksy: Use the Status filter to toggle between "Live" marks (active registrations), "Pending" marks (applications in progress), and "Dead" marks (abandoned or cancelled).
Why it matters: A dead mark may indicate that the owner abandoned for non-use, or it could have been cancelled due to non-renewal—the original owner might still be using it.

Bonus Tips for Better Searches

  • Save your searches: Log in to save and compare multiple search results
  • Export results: Download search results as PDF or CSV for review
  • Set up monitoring: Get alerts when new similar marks are filed
  • Consider design marks: If you have a logo, search for similar designs too
  • When in doubt, go comprehensive: Our professional comprehensive search covers databases you can't access yourself
