The $350 USPTO fee is a government filing fee charged per trademark class. It's required for all applications and is separate from our service fee.
What is a "class"? Trademarks are organized into 45 categories (classes) based on what you sell:
- Class 25: Clothing
- Class 35: Retail/advertising services
- Class 42: Software/technology services
Most businesses need 1-2 classes. If you sell both products AND services, you may need multiple classes ($350 each).
™ (Trademark symbol): Anyone can use this to claim trademark rights, even without registration. It provides limited protection.
® (Registered symbol): Can ONLY be used after your trademark is officially registered with the USPTO. Using ® without registration is illegal.
Once registered, you get nationwide protection, the right to sue in federal court, and the ability to register with U.S. Customs to stop counterfeits.
If the USPTO has concerns, they send an "Office Action" explaining the issue. Common reasons include:
- Likelihood of confusion: Too similar to existing trademark
