Applicant's goods consist exclusively of facial skincare products used to cleanse, moisturize, exfoliate, and maintain facial skin. These products are cosmetic preparations applied directly to the face and are purchased by consumers seeking facial skincare solutions. In contrast, Registrant's goods are bath brushes, which are handheld cleansing implements classified in a different international class and used as personal care accessories rather than skincare preparations. Importantly, Applicant's amended goods are facial-specific products that are not used in conjunction with bath brushes. Consumers ordinarily apply facial cleansers, facial lotions, facial moisturizers, facial oils, and facial creams using their hands or other facial skincare applicators specifically designed for use on facial skin. Bath brushes, by contrast, are generally intended for cleansing and exfoliating the body during bathing. As a result, the goods differ in purpose, function, method of use, and consumer expectations. The Examining Attorney's evidence focused largely on registrations and third party websites showing body lotions, soaps, body washes, and similar bath-related products offered together with bath brushes. However, Applicant has now deleted those goods and limited its application to facial skincare products only. Consequently, the evidence of record no longer reflects the goods identified in the application as amended. Accordingly, consumers are unlikely to believe that facial cleansers, facial moisturizers, facial creams, facial oils, and related facial skincare preparations originate from the same source as bath brushes merely because they are offered under similar marks. Given the substantial differences in the nature, purpose, and use of the parties' respective goods, this DuPont factor weighs against a finding of likelihood of confusion. Thus, because Applicant's amended facial skincare goods are distinct from Registrant's bath brushes, there is no likelihood of confusion as to source.
